1. Introduction

By purchasing or using the Timeless Love Preset Collection ("Preset"), you ("User") agree to abide by the terms and conditions outlined herein. These terms govern the use, distribution, and intellectual property rights related to the Preset. Please read carefully before proceeding with your purchase or use.

2. Ownership and Copyright

The Timeless Love Preset Collection is the exclusive property of Shan Fisher Education and is protected by copyright law. All materials, including but not limited to digital files, presets, associated documentation, and any accompanying media, are the intellectual property of Shan Fisher Education.

  • Copyright Protection: The Preset is protected by international copyright laws and may not be shared, copied, reproduced, or redistributed without express written permission from Shan Fisher Education.

3. License Grant

Upon purchase, Shan Fisher Education grants you a non-exclusive, non-transferable, revocable license to use the Timeless Love Preset Collection for personal and professional use only, subject to the terms below:

  • Permitted Use: You may use the Preset for editing photographs in personal or commercial photography projects. You are allowed to create works for clients using the Preset, provided the work is part of a service, not a resale of the Preset itself.
  • Prohibited Use: You may not:
    • Share, distribute, resell, sublicense, or give the Preset to any third party, including uploading to file-sharing platforms or distributing via social media, websites, or other channels.
    • Modify the Preset for redistribution or resale under your name or brand.
    • Claim ownership of the Preset or any derivative thereof.

4. Usage Limitations

  • The Preset is licensed to one individual (the User) per purchase. Sharing access to the Preset with other individuals, including but not limited to colleagues, business partners, or friends, is prohibited.
  • Users are responsible for ensuring the security of the Preset files. Shan Fisher Education is not liable for lost, stolen, or damaged files after the purchase is completed.

5. Refund Policy

Due to the digital nature of the Preset, all sales are final. No refunds, exchanges, or returns will be issued once the files have been downloaded. By making a purchase, you agree that the Preset is a non-tangible, irrevocable good and waive any right to claim a refund.

6. Limitation of Liability

Shan Fisher Education is not responsible for any issues, damages, or losses arising from the use or inability to use the Preset, including but not limited to technical incompatibilities or software malfunctions. The Preset is provided "as is" without any guarantees or warranties of any kind, either expressed or implied, including but not limited to warranties of fitness for a particular purpose or merchantability.

7. Updates and Modifications

Shan Fisher Education reserves the right to update, modify, or discontinue the Preset at any time without notice. Any updates provided to the User are subject to the same terms and conditions as the original purchase unless otherwise specified.

8. Termination

Failure to comply with the terms and conditions outlined in this agreement may result in the immediate termination of your license to use the Preset. Upon termination, you must cease all use of the Preset and destroy any copies of it in your possession.

9. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under or related to this agreement shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
